Section 1 Scope of Application - Subject Matter of the Contract
(1) The following General Terms and Conditions apply to all contracts between Werbegams and consumers (hereinafter: Customer) for the purchase and delivery of goods or digital content via the webshop https://www.sporty.photos
(2) The following applies to commercial customers: Deviating terms and conditions of the customer are not binding upon us, even if we do not expressly object to them. If you wish to acquire a license for images for commercial use, please contact us directly. Licensing to commercial customers or for commercial use is not offered via our website and is only possible by separate agreement.
Section 2 Offer, Conclusion of Contract
(1) The presentation of products on our website does not constitute a legally binding offer, but rather an invitation to place an order. The selected goods or digital content will be displayed in your shopping cart. Here, you have the opportunity to correct any input errors or modify your order before submitting it.
(2) By clicking the [Buy / Order with obligation to pay] button, you submit a binding offer to purchase the goods or digital content contained in your shopping cart. However, the offer can only be submitted and transmitted if the customer accepts these terms and conditions by activating a checkbox labeled "Accept Terms and Conditions" and thereby incorporates the content of the Terms and Conditions into their offer.
(3) Confirmation of receipt of the order, along with acceptance of the order, is sent immediately after submission via an automated email. The purchase contract is concluded upon receipt of this email confirmation. Notwithstanding the above, if you have chosen credit card payment, the contract is concluded at the time your credit card is charged, and if you have chosen PayPal as your payment method, at the time you confirm the payment instruction to PayPal.
(3) Confirmation of receipt of the order, along with acceptance of the order, is sent immediately after submission via an automated email. (4) During the ordering process, the customer can select their preferred language for concluding the contract from the available languages in the navigation menu.
Section 3 Prices
(1) The prices listed on the product pages include statutory VAT and all other price components. Unless otherwise agreed upon in writing, the prices valid on the day of the order apply.
(2) Current prices vary depending on the event. The payment currency and price are set separately for each event. The respective price list can be found in the price table for the corresponding event (Event Price List).
Section 4 Delivery and Payment
(1) We always strive for prompt delivery of ordered images. The delivery time depends on the chosen payment and delivery method. Delivery options include delivery via download link and delivery as a photo print on canvas or poster. Delivery via download link is always provided; delivery as a photo print takes place within a maximum of 14 business days (Monday to Friday).
(2) For payments made by credit card or PayPal, digital images will be sent no later than two business days after ordering. However, we strive for delivery within 24 hours. Delivery after prepayment will take place within two business days after confirmation of receipt of the payment in our account. For photo prints, the delivery time is extended by a maximum of 14 business days (Monday to Friday).
(3) After receipt of payment by Werbegams, the customer will receive the download link for the ordered images via email. This download link will be available to the customer for 90 days. Should the download attempt fail, a free re-delivery will be provided upon request. Please contact info@sporty.photos for this.
§ 5 Retention of Title
The goods remain our property until full payment has been received.
§ 6 Shipping Costs
(1) There are no shipping costs for delivery via download link.
(2) We charge shipping costs for delivery as photo prints. The shipping costs vary depending on the order quantity and include shipping, material, and processing costs.
Section 7 Customer Account
(1) We provide our customers with a customer account where they can view their previous orders.
(2) You can access your customer account by entering your personal login details.
(3) A customer account is not mandatory. You can also place an order as a guest.
Section 8 Warranty
We always strive to deliver professional and sharp images. In the case of justified complaints, we adhere to the statutory warranty regulations. Replacement of items purchased by the customer after
